ECZ DISMISSES EFFORT TO TAKE BACK COUNCILLOR’S RESIGNATION
The Electoral Commission of Zambia (ECZ) has officially turned down the request from Kimasala Ward Councillor Bernard Kakinga to take back his resignation, stating that this action cannot be reversed according to the constitution.
ECZ Chief Electoral Officer Brown Kasaro explained that, based on Article 157 of the Constitution of Zambia, once a councillor resigns, that decision is final and cannot be changed.
In a letter sent to the Town Clerk of Solwezi Municipal Council, Mr. Kasaro referenced the legal case of Isaac Mwanza vs. The Electoral Commission of Zambia and the Attorney General, which shows that the law does not allow a councillor to withdraw their resignation after it has been submitted.
Following this news, Solwezi Town Clerk Stanley Mbewe has called on all political parties to get ready for the upcoming by-election. He also encouraged the people of Kimasala Ward to take part in the democratic process by voting for a new representative.
