Kabesha Clarifies: No Official Appeal Filed Yet in Lungu Repatriation Case, Only ‘Leave to Appeal’ Application

Attorney General Mulilo Kabesha has clarified that the family of late former President Edgar Lungu has not yet filed an official appeal in the South African courts regarding the repatriation of his remains to Zambia.

Mr. Kabesha explained that the family has only submitted an online application for “Leave to Appeal,” which was filed electronically on Friday, August 8, 2025, at around 16:00 hours.

This development follows the recent ruling by the Pretoria High Court, which ordered that President Lungu’s remains be repatriated to Zambia for burial at Embassy Park. Acting Judge President Aubrey Ledwaba, delivering the judgment on behalf of a three-judge panel, further directed that the late President be accorded a State Funeral in accordance with Zambian law.

Speaking during ZNBC’s Sunday Interview on TV1, Mr. Kabesha said the court is expected to decide on Monday, August 11, 2025, whether the family will be granted permission to proceed with the appeal.
