Two Chipata Women Sentenced for Insulting President Hichilema on TikTok

In a significant legal ruling, two women from Luangeni Constituency in Chipata, Eastern Province, have received prison sentences for creating offensive TikTok videos that insulted President Hakainde Hichilema and accused him of being responsible for the death of former President Edgar Lungu.

Catherine Mphanza and Mary Lungu were apprehended on June 24, 2025, after three videos featuring their derogatory remarks circulated widely, provoking public outrage. They appeared before Chipata Magistrate Destiny Kalusopa, where both women admitted guilt to charges under the Cyber Crimes Act No. 4 of 2025.

Mphanza faced two counts, while Lungu faced one, as outlined in Sections 22(1)(a) and 3 of the Act, which prohibits harassment and humiliation on digital platforms.

During their sentencing, the women expressed regret and claimed they were under the influence at the time of filming. They sought leniency, asserting they were not fully aware of their actions.

Despite the possibility of a fine of up to K80,000, Magistrate Kalusopa opted for custodial sentences, emphasizing the severity of the offenses and the need to protect the dignity of the presidency. He noted that such measures were essential to deter future misconduct and maintain respect for the Office of the President.

Catherine Mphanza received an 18-month simple imprisonment sentence for each of her two counts, to be served consecutively. Mary Lungu was sentenced to 24 months of simple imprisonment for her single count. Both sentences are effective from the date of their arrest, June 24, 2025.

One of the videos featured Mphanza using offensive language and stating that she would not support President Hichilema in the upcoming 2026 general elections. Another video showed Lungu making fun of the President’s appearance and making provocative accusations regarding the death of former President Edgar Lungu.

This case has sparked renewed discussions about the responsible use of social media and the potential legal repercussions of online misconduct in Zambia.
